This training provides participants a first-hand experience and advanced knowledge of the ICC Arbitration procedure through practical and interactive sessions. Participants will study the arbitration proceedings through the simulation of a mock case.
By the end of the programme, participants will be able to:
• Understand the ICC Rules and practice of International Commercial Arbitration • Set up the strategy and draft all documents submitted to the Arbitral Tribunal (Request for arbitration, Answer to the Request for arbitration, Submissions, Post-hearing briefing documents) • Analyze the different procedural options and dispute resolution methods, identify the parties and select the claims and the counter-claims to be raised • Deal with multi-party and multi-contract arbitrations and consolidation proceedings • Identify and deal with jurisdictional objections • Manage complex situations during the conduct of the proceedings • Draft the Terms of Reference and the Procedural Timetable • Organize the hearings and resolve procedural incidents • Identify the issues involving local courts • Use the Emergency Arbitrator in order to achieve an urgent conservatory or interim measure • Practice the examination and the cross-examination of witnesses and experts during the study of the mock case • Understand Arbitral Tribunal’s deliberations and discussion • Understand ICC Court’s expertise on awards • Achieve the enforceability of an award
